Why we won't be voting on the fees this year (maybe ever!)

So the oft quoted voters right to approve fees, taxes and loans may not stand up to legal scrutiny. The Late Charles Troutman issued this opinion in September of this year - I suppose it's ripe for some kind of challenge...wonder who will bring it?
